Domain Scraper Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of the Domain Scraper platform and its services provided by Domain Scraper (“we,” “us,” or “our”). By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our platform.

1. Services provided

  1. Domain Scraper provides extensive domain insights and website metadata to help customers make informed decisions, assess competitive standings, and improve upselling strategies.
  2. Services are accessible through our API and the app hosted at app.domainscraper.online.

2. Access to services

  1. Customers are onboarded after direct contact with us.
  2. We provide an initial login to the platform.
  3. Customers can create API access keys for specific access levels (read, write, read-write) via the API interface.

3. Acceptable use

  1. When using our platform, you agree to refrain from:
    • Engaging in illegal activities.
    • Exploiting vulnerabilities in our systems or API.
    • Sharing login credentials with unauthorized parties.
    • Overloading or attempting to disrupt our platform’s functionality.
  2. Violation of these terms may result in immediate termination of access.

4. Prohibited conduct

  1. The following behaviors are strictly prohibited:
    • System abuse, including spawning multiple processes that consume excessive resources.
    • Actions disrupting or overburdening our systems.
    • Attempts to breach platform security or access unauthorized data.
  2. Engaging in these activities may lead to account termination, legal action, and notification of appropriate authorities.

5. Pricing and payments

  1. Payments are due according to the terms specified in the plan chosen by the customer. All payments must be made in Euros (EUR) unless otherwise specified.
  2. Invoices are generated monthly, and payments are due within 14 days of the invoice date unless otherwise agreed upon in writing.
  3. Late payments may incur interest at a rate of 1.5% per month or the maximum allowed by law, whichever is less. Domain Scraper reserves the right to suspend services for accounts with overdue balances.
  4. Accepted payment methods include bank transfers and other options specified on the invoice or pricing page.
  5. All fees are exclusive of applicable taxes, which customers are responsible for paying.

6. Cancellation policy

  • Contracts have an initial term of four (4) months.
  • After the initial term, cancellations require a one (1) month notice period.
  • Customers remain responsible for all charges incurred during the notice period.

7. Account registration

  1. Accounts are created as part of an onboarding process initiated through direct communication with us.
  2. Customers are responsible for securing their access credentials and ensuring that only authorized individuals access the platform.

8. Account termination

  1. We may terminate or suspend access to your account if:
    • You fail to pay outstanding fees.
    • You breach these Terms or engage in prohibited activities.
    • We determine that your actions compromise the security or functionality of our platform.
  2. Termination notices will be provided whenever reasonably possible.
  3. Upon termination, all data and access credentials will be revoked, and any outstanding balances must be settled immediately.

9. Data collection and privacy

  1. We log API calls and customer information for billing and customer administration purposes.
  2. Our use of external APIs for GEO information and RDAP data complies with applicable privacy regulations.

10. Intellectual property

  1. The structured data and information available on our platform remain the property of Domain Scraper.
  2. Customers are granted a limited license to use this data for their business purposes but are prohibited from exposing large amounts of structured data for commercial purposes without explicit permission.
  3. Customers may not sublicense or share the data with unauthorized third parties.

11. Disclaimer of warranties

  1. Our services are provided “as is” and “as available,” without any warranties, express or implied.
  2. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
  3. We do not guarantee uninterrupted, timely, secure, or error-free services.

12. Limitation of liability

  1. We are not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our platform.
  2. Liability is limited to the greatest extent permissible under Dutch law.

13. Indemnity

  1. You agree to indemnify and hold harmless Domain Scraper, its partners, affiliates, and contractors from any claims or demands, including reasonable attorneys’ fees, made by any third party due to or arising from your use of our services, violation of these Terms, or infringement of any rights.

14. Governing law and dispute resolution

  1. These Terms are governed by the laws of The Netherlands.
  2. Disputes will be resolved in accordance with Dutch law, with proceedings conducted in Almere (NL).

15. Modifications to terms

  1. We reserve the right to modify these Terms at any time.
  2. Changes will be communicated via the website or other appropriate means. Continued use of the platform constitutes acceptance of the updated Terms.

16. Force majeure

  1. We are not liable for delays or failures to perform due to events beyond our reasonable control, including natural disasters, governmental actions, or other unforeseen circumstances.

17. Third-party integrations

  1. We are not responsible for the availability, accuracy, or performance of third-party APIs or services used in conjunction with our platform.
  2. Use of these services is subject to their respective terms.

18. Severability

  1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire agreement

  1. These Terms constitute the entire agreement between you and Domain Scraper regarding the use of our platform and services, superseding any prior agreements or understandings.
